The Inspector General of Police (IGP), Ibrahim Idris, has asked a Federal Capital Territory High Court for an order restraining the committee set up by the Senate to investigate alleged illegal collection of money from companies and highly placed persons before posting policemen out.
IGP Idris, in the suit filed yesterday at the registry of the court also wants the court to restrain the Senate President and the entire Senate from receiving and discussing any report submitted to it by the committee set up to investigate the allegations against him.
The fundamental rights enforcement suit, which was filed by his lawyers, Charles Ogoli, Emmanuel Anene and Solomon Ayangkong Ikongshul, joined Senate President Bukola Saraki and the Senate of the Federal Republic of Nigeria as respondents.
In the suit, the IGP stated that one Senator Isa Misau, while raising matter of urgent national importance between September and October, 2017 accused him of mounting road blocks across Nigeria with the purpose of extorting money from unsuspecting motorists.
He also stated that the said senator in the motion, also accused him of collecting illegal fees by way of security protection given to corporate organisations, eminent citizens and oil companies running into billions of naira.
Idris also stated that Misau accused him of having “unwholesome relationship with female officers in the force.”
He stated further that, “Without the 1st Respondent having regard to the relevant constitutional requirements in respect of the 2nd Respondent’s role in investigations of allegations, he, in reaction to these frivolous allegations, quickly constituted a committee consisting members of the 2nd Respondent to look into the matter.”
No date for the hearing.
Meanwhile, the federal government about two days ago, filed criminal charges against Senator Misau.
The charges were filed by the office of the attorney-general of the federation (AGF) at the federal high court, Abuja, and the other before the FCT high court.
The suits follow the disagreement between the senator and Ibrahim Idris, inspector-general of police (IGP).
The police had declared Misau a deserter after he accused the IGP of collecting money from police officers before they are posted.
He also accused Idris of collecting money from oil companies and banks where police officers are sent to provide security.
Misau is accused of forging false documents comprising affidavits and declaration of age he deposed to, at the Bauchi State Health Management Board Birth Certificate and FCT high court.
He is said to have submitted these documents to the Independent National Electoral Commission (INEC) in 2011 and 2014 when he ran for public office.
The senator is also accused of making false statements that police officers pay N2.5 million to get special promotion and posting and also claiming that N10 billion is being received by Idris from oil companies and banks.
The offences are said to be contrary to section (1)(2)(c) of the miscellaneous offences Act Cap M17, laws of the Federation of Nigeria, 2004 and punishable under the same section of the Act.
The suit against Misau is coming a few days after the Senate set up an ad hoc committee to probe the senator’s claims against Idris
Part of the charges filed before the FCT High Court read in part, “That you, lsah Hamman Misau of Hamman Misau Residence, Turaki Street, Misau, Bauchi State, on, or about August 10, 2017, at Abuja and other part of Nigeria within the jurisdiction of this Honourable Court, did make a false statement of fact to wit: that police officers pay as much as two million, five hundred thousand naira (N2.5m) to get special promotion and posting through the Police Service Commission as published in the Daily Trust Newspaper dated August 10, 2017, knowing that such false statement of fact would harm the reputation of Mr. Ibrahim Kpotun ldris (the serving Inspector-General of Police), the Nigeria Police Force and the Police Service Commission and you thereby committed an offence.
