In the petition contesting the outcome of the presidential election on February 25, the Independent National Electoral Commission (INEC) failed to call its first witness.
Following the resolution of the cases of the Allied People’s Movement (APM), Labour Party (LP), and Peoples Democratic Party, the Presidential Election Petitions Court, presided over by Justice Haruna Tsammani, had on June 23 ordered INEC to begin their defense on July 3.
However, the counsel for INEC, Abubakar Mahmoud (SAN), informed the court at the resumed hearing on Monday that, of the three witnesses they planned to call, only the first could make it because of some family obligations.
He begged for a postponement to Tuesday so the witness could attend.
Mahmoud’s request was not opposed by the attorneys for the LP, Livy Uzoukwu (SAN), President Bola Tinubu and Vice President Kashim Shettima, Wole Olanipekun (SAN), or the APC, Lateef Fagbemi (SAN).
Justice Tsammani decided to postpone the petition’s hearing until Tuesday.
